1–9. General terms (pending)
Sections 1 through 9 of these Terms cover standard subscriber provisions (account creation, acceptable use, subscription and payment, intellectual property, warranty disclaimer, governing law, and dispute resolution). These sections are currently under legal review and will be published in the final version before the Belima iOS app launches.
In the meantime: your use of belima.app (the public website and waitlist) is governed by Danish law and the privacy policy at belima.app/privacy. For questions, contact belimaapp@gmail.com.
10. Liability for the Dead-Man's-Switch (draft)
10.1 Belima's responsibility — technical operation
Belima is responsible that:
- The Dead-Man's-Switch system functions technically as described, including sending notifications (email, SMS, push) within the promised timeframe.
- Scheduled jobs run as planned with reasonable reliability.
- Video content is automatically released to trusted contacts when the waiting period expires without user confirmation.
- The system is reasonably secured against unauthorised access and manipulation.
Belima cannot guarantee 100 % delivery rate for email or SMS, as this depends on third-party providers (e.g., telecom carriers).
10.2 Events outside Belima's control
Belima is not responsible for:
- User non-response: If you do not respond to notifications within your chosen waiting period (7, 14, 30, or 90 days), videos are released automatically as planned. It is your responsibility to ensure you can reach all three communication channels (phone, email, app).
- Technical unavailability on your side: If you cannot receive SMS (phone off, no signal, or abroad), or cannot open email or app, this is not Belima's responsibility. You accept this risk when you choose your waiting period.
- Malicious action by a trusted contact: If a trusted contact deliberately triggers release prematurely, Belima is not liable for resulting damages. See section 10.5 regarding compensation.
- Force majeure: System outages at cloud providers, internet connectivity failures, cyberattacks on third parties, or force majeure events (war, natural disasters, pandemics).
10.3 Your responsibility
You agree that:
- You will regularly confirm your status in the Belima app so the system knows you can still reach the notification channels.
- It is your responsibility to keep your contact information (phone number, email address) up to date.
- You will choose trusted contacts you actually trust, and who will respect your wishes.
- You will inform your trusted contacts of their role and responsibility.
10.4 Release cannot be revoked after download
Once your videos are released to trusted contacts and downloaded to their device, Belima cannot technically enforce deletion of those copies. After release, Belima deletes the encrypted blobs from its servers within 30 days. The trusted contact may keep, copy, share, or use the video within the limits of the law. You accept this when you create messages in Belima.
10.5 Liability for malicious trigger
A trusted contact who deliberately misuses their role to trigger release without cause may be liable for damages under Danish tort law (Erstatningsansvarsloven) § 23 (liability for intentional or grossly negligent harm). Belima does not guarantee control over trusted contacts' actions but encourages you to choose people you can fully rely on.
10.6 Liability cap
To the extent permitted by Danish law, Belima's total liability to you is limited to the amount you have paid for the Belima service in the past 12 months, and in any case capped at 1,000 DKK. This cap does not apply to personal injury.
10.7 Governing law
These terms are governed by Danish law. Any dispute shall be settled before Danish courts.
